On 14 October, the Administrative Appeals Tribunal (AAT) was replaced by a new body called the Administrative Review Tribunal (ART).

This new Tribunal can review and change decisions made by government agencies, including decisions made by the National Disability Insurance Agency (NDIA).

All current matters at the AAT have been transferred to the ART.

The new ART will:

  • be fair, accessible and transparent
  • resolve applications in a timely manner
  • be responsive to the needs and circumstances of applicants.

NDIS participants and applicants who have applied to the AAT to review a decision do not need to do anything. They do not need to start again or ask for a new review. All active cases have moved to the new Tribunal.

According to the government, if you have received an AAT decision, your matter is considered finalised. It will not be considered again by the ART.

Active cases will receive information and notifications about their case from the new Tribunal.

Why has the AAT changed to the ART?

The reform was informed by:

  • public consultation undertaken in April and May 2023
  • guidance from the Administrative Review Expert Advisory Group
  • close engagement across government and with the AAT
  • targeted consultation on draft legislation in September and October 2023, and
  • the parliamentary scrutiny process.

The ART is guided by strong safeguards to protect the integrity of the assessment process.
